Database of Musical Works

In the database, you can search for musical works and lyrics not only by Czech and foreign represented authors but also by authors represented through the publisher. The search results are informational and serve for your quick and easy orientation in the represented works. The service displays only works represented by OSA in the area of voluntary collective management of the right to live performance of the work and its transmission according to § 19 of the Copyright Act. Therefore, the results do not show, for example, works represented only in the area of extended and mandatory collective management or in other areas of voluntary collective management than live performance of the work. If the abbreviation “NS” is indicated for a specific rights holder, it means that OSA does not manage the rights of the relevant share in that copyrighted work.

Notice:

OSA reserves the right to prevent commercial exploitation of works from the OSA repertoire for the purposes of machine learning and training generative artificial intelligence models. It is not possible for providers and deployers of AI models to exploit the work of authors in this way without their consent, so they must obtain the appropriate license, which OSA is prepared to provide. 1. General

1.1. The owner and operator of the OSA Search web service (hereinafter referred to as the "Service") on the website www.osa.cz is OSA, z.s., ID: 6383997, Čs. armády 20, Prague 6 (hereinafter referred to as "OSA").
1.2. The Service is operated pursuant to § 99j of Act No. 121/2000 Coll., on Copyright, Rights Related to Copyright, and on Amendments to Some Acts (the Copyright Act), as amended (hereinafter referred to as the "CA"), for the purpose of searching information by collective management organizations for which OSA manages rights under a contract pursuant to § 97g CA, rights holders, and users (collectively referred to as "users") in the online database of musical works from the OSA repertoire managed within the territory of the Czech Republic in the area of so-called live performance of the work and its transmission pursuant to § 19 CA.
1.3. By using this Service, the user confirms that they agree with the terms of use of this Service as set forth in these Terms.
1.4. The Service does not display all works and rights managed from the OSA repertoire. The nature of this Service is purely informational. Information obtained through this Service has no legal relevance.

2. Permitted Use

2.1. This Service may be used to ascertain basic information about the OSA repertoire, particularly for the purposes of negotiating license agreements between OSA and users or for other dealings in the interest of the rights holders themselves. For this purpose, OSA provides the searched information to users free of charge.
2.2. It is prohibited to use any automated system or software for data collection while using this Service. Furthermore, it is prohibited for anyone to handle the search results obtained through the Service in any way (distribute, share, trade, etc.) or otherwise use them, whether free of charge or for profit generation.
2.3. In case of unauthorized use of this Service, OSA is entitled to prevent such use and take appropriate legal action, including filing a lawsuit, even without prior notice.

3. Intellectual Property Protection

3.1. All information, data, and materials used in this Service, including names, logos, and other elements, as well as color schemes and page layouts, are subject to copyright, trademark rights, database rights, and/or intellectual property rights.
3.2. Any other use or reproduction of this content without the prior written consent of OSA is prohibited and will be considered a breach of these Terms.

4. Links to the OSA Search Service from Other Websites

4.1. It is prohibited to create and manage links to this Service from other websites.

5. OSA’s Liability for Use of the OSA Search Service

5.1. OSA is not liable for any loss and/or damage caused in connection with the use of this Service.
5.2. OSA is also not liable for the use of information provided in this Service.

6. Applicable Law and Jurisdiction

6.1. The use of this Service is governed by the applicable laws of the Czech Republic.
6.2. The general courts of the Czech Republic are materially and territorially competent to resolve disputes arising from use of this Service.
